Terms & Conditions

Making sure we're on the same page when we work together.
General Terms & Conditions:
  1. Scope of Services:
    Blue Fairy Design Solutions provides design, marketing, and consultation services as outlined in the agreed package or session plan. Any additional work outside the agreed scope will require separate discussion and may incur additional charges.

  2. Payment Terms:
    Payment for services, including bulk packs, must be made upfront unless otherwise agreed. Payment confirms your booking and commitment to the terms outlined here.

  3. Confidentiality:
    I respect the confidentiality of your business information and will not share any sensitive details without your express consent.

  4. Client Responsibilities:

    • You agree to provide necessary information, feedback, and access to relevant platforms (e.g., website, social media) in a timely manner to ensure smooth progress.

    • Collaboration is key; delays in providing required materials or approvals may impact timelines and incur additional charges.

  5. Ownership of Work:
    Upon final payment, you will own the final deliverables created specifically for your business. However, Blue Fairy Design Solutions retains the right to use non-confidential work for portfolio purposes unless otherwise agreed.

  6. Rescheduling & Cancellations:
    Policies for rescheduling and cancellations are detailed in the respective service agreements (e.g., Bulk Pack, Power Hour sessions, Monthly Marketing Management and Design Projects).

  7. Refunds:
    Refunds for services will only be issued in exceptional circumstances, at my discretion. Work already completed will be billed at the standard hourly rate and deducted from any refundable amount.

  8. Force Majeure:
    Neither party shall be liable for delays or failure to perform services due to circumstances beyond their reasonable control, including natural disasters, illness, or technical failures.

  9. Amendments to Terms:
    Blue Fairy Design Solutions reserves the right to amend these terms and conditions. Clients will be notified of any changes, and continued use of services constitutes acceptance of the updated terms.

  10. Dispute Resolution:
    In the event of a dispute, both parties agree to communicate openly and work towards a resolution in good faith.

  11. Governing Law:
    These terms are governed by the laws of NSW, and any disputes will be subject to the jurisdiction of the courts in this area.

Cancellation Policy for Monthly Marketing Management:
  1. Notice Period:
    To cancel your monthly marketing management service, please provide at least 30 days' written notice. This allows time to wrap up ongoing tasks and ensure a smooth transition.

  2. Mid-Month Cancellations:
    If cancellation occurs mid-month, the full month’s payment is required, and services will continue until the end of the billing cycle.

  3. Refunds:
    Monthly fees are non-refundable once paid. Any unused services within the billing cycle will not be eligible for a refund.

  4. Reactivation:
    If you decide to resume marketing management services after cancellation, reactivation will depend on availability and may require a new agreement.

  5. Termination by Blue Fairy Design Solutions:
    In rare cases where the agreement needs to be terminated by me (e.g., due to unforeseen circumstances or a breach of terms), I will provide at least 30 days' notice, and any unused portion of the month will be refunded.

  6. Ongoing Obligations:
    It is the client’s responsibility to ensure access to relevant accounts, platforms, and materials remains available until the cancellation takes effect. Delays in this process may affect the completion of outstanding tasks.

  7. Final Deliverables:
    At the end of the service, I will provide any outstanding deliverables or reports created during the contract term.

Cancellation Policy for Bulk Pack (8 Power Hours):
  1. Validity Period:
    Bulk packs are valid for six months from the date of purchase. Any unused hours after this period will expire and are non-refundable.

  2. Rescheduling:
    If you need to reschedule a booked session, please provide at least 48 hours' notice. Rescheduling requests made with less than 48 hours’ notice may result in the session being deducted from your bulk pack.

  3. Cancellation:
    Cancellations made more than 48 hours in advance will not incur any charges, and the session will remain available for future use within the validity period. Cancellations made with less than 48 hours’ notice will result in the session being forfeited.

  4. No-Shows:
    If you do not attend a booked session without prior notice, the session will be considered used and deducted from your bulk pack.

  5. Refunds:
    Bulk packs are non-refundable once purchased. In exceptional circumstances, requests for refunds may be considered at my discretion, minus any hours already used at the standard Power Hour rate.

  6. Termination of Agreement:
    If either party chooses to terminate the agreement before all hours are used, any remaining hours may be forfeited unless otherwise agreed upon.

Cancellation Policy for Website and Branding Design Projects:
  1. Deposit and Initial Payment:
    A non-refundable deposit of 50% is required to secure your project. This deposit covers the time and resources allocated to initial planning and design stages and reserves your place in my very limited intake for the year.

  2. Cancellation Before Project Start:
    If you cancel before the project begins, any payment beyond the non-refundable deposit will be refunded, and depending on the length of notice given the deposit amount may be negotiated.

  3. Cancellation After Project Start:

    • If you choose to cancel after the project has started, you will be invoiced for all work completed up to the cancellation date. This amount will be deducted from any payments already made, and the balance (if applicable) will be refunded.

    • All work completed up to the point of cancellation will be delivered to you in its current state, provided all outstanding invoices are paid.

  4. Notice Period:
    To cancel your project, please provide written notice at least 14 days in advance. This allows for a smooth wrap-up of tasks and handover of any deliverables.

  5. Termination by Blue Fairy Design Solutions:
    In rare cases where the agreement needs to be terminated by me (e.g., due to unforeseen circumstances or breach of terms), you will receive a pro-rated refund for work not yet completed.

  6. Ownership of Work:
    Ownership of all deliverables is contingent on full payment of invoices. Work completed but not paid for remains the property of Blue Fairy Design Solutions.

  7. Reactivation:
    If the project is paused or canceled and later reactivated, a new timeline and agreement will need to be established, and reactivation may depend on availability.
